DP World – Protected Industrial Actions (PIA) Update
Please click here for update on recent developments with ongoing protected industrial action by the CFMMEU-MUA Division (MUA) at DP World terminals in Sydney, Melbourne, Brisbane and Fremantle, now extended through to 8 January 2024.
We understand that the MUA and DP World are scheduled to meet on Fri 22 December 2023 AM and hope that, in the spirit of the season, both parties can reach agreement on all outstanding issues at the earliest opportunity.
Separate to this, IFCBAA will continue to maintain contact with senior DP World management and provide pertinent updates as they come to hand.

The ongoing protected industrial action, which has seen rolling stop work bans since 6 October, is having a profound impact on small and medium-sized enterprises in Australia. DP World is committed to fostering Australia’s modernised supply chain and finding a mutually beneficial resolution.
DP World is committed to keeping Australia’s economy moving and minimising disruption.
We remain dedicated to a cooperative and productive dialogue to find a mutually beneficial solution. However, despite our best efforts to reach an understanding, the CFMMEU-MUA DIVISION has outlined a series of work bans and stoppages from Monday, 18 December to Sunday, 31 December.

Unfortunately, there is little change in that DP World today have announced another update suggesting the members of the Construction, Forestry, Maritime, Mining and Energy Union (CFMMEU, MUA Division) have, despite continued efforts to reach an understanding, outlined a further series of work bans and stoppages up to and including Monday 11 December.

UPDATE ON DP WORLD'S RECENT CYBERSECURITY INCIDENT
Dear Valued Partners,
I hope this message finds you well.
I am writing to inform you about a recent cybersecurity incident that has impacted DP World Australia, and the steps we have taken in response.
Incident Overview On Friday, 10th November 2023, our technology team detected unauthorized access to DP World Australia’s corporate network. To contain this incident, we disconnected our network from the Internet, which temporarily impacted land-side port operations but was successful in containing the breach.
Response and Recovery Since the detection of the breach, our team, along with expert advisers, has worked tirelessly to restore operations and assess the impact. By Monday, 13th November, we were able to recommence port operations. Our incident response strategy was pivotal in effectively managing this situation. As of 20th November, we have cleared the entire backlog of 30,137 containers.
Investigation and Security Our investigation confirmed that the incident was confined to our Australian operations and did not involve ransomware or affect any other markets where DP World operates. However, we regret to inform you that some files were accessed, and a small amount of data was exfiltrated. Importantly, customer data was not impacted, but some personal information of current and previous employees was affected.
Support for Impacted Individuals We are in the process of notifying impacted individuals and have established a cyber response team to offer support. This includes assistance through Employee Assistance Programs and services from IDCARE and Equifax.
Collaboration and Gratitude Throughout this incident, we have worked closely with Australian cybersecurity and law enforcement agencies, government departments, and state and territory agencies. We extend our gratitude for their invaluable support.
Acknowledgment and Thanks As a key part of Australia’s logistics and supply chain, we understand the significance of this incident. We extend our sincere thanks to our customers, employees, and stakeholders for their patience and support during this challenging time.

Freight & Trade Alliance (FTA) and the Australian Peak Shippers Association (APSA) have been maintaining close engagement with DP World in regard to recovery, and with the Container Transport Alliance Australia (CTAA) to ascertain operational impacts from a transport operator’s perspective as DP World continue to recover from their recent cyber incident and management of ongoing Protected Industrial Action. To that end, we refer to an update produced by CTAA last week addressing the significant national landside delays and costs; announcement of DP World changed roster arrangements; and calls for Federal Industrial Relations Minister intervention to terminate industrial action - refer HERE.
In terms of recovery, DP World has informed FTA / APSA that of the ~30,000 containers impacted by the cyber incident, as of last week DP World has since successfully moved 14,265 containers of the total. Significant strides were made last week with over 6,000 containers moved on Thursday alone by road and rail following a day of significant impacts due to protected industrial action.

Despite these recovery efforts, transport companies have communicated that in some cases, surcharges for containers arriving into DP World terminals will be applicable. Also, surcharges for weekends and/or after-hours collections will be applied as they strive to retrieve containers within their allotted free time.
On top of this, DP World are also planning a Stop Work Meeting as follows:

Date and Time: Tuesday, 28th November 2023
Locations and Schedule:
DP World Brisbane: 7 am – 11 am
DP World Sydney: 10 am – 2 pm
DP World Melbourne: 10 am – 2 pm
DP World Fremantle: 9 am – 1 pm
Impact: All DPWA terminal operations will cease during these periods due to an authorized four-hour MUA stop work meeting.
These bans & stoppages continue to significantly impact our services, and we appreciate your understanding and flexibility during this period. Our team is committed to minimising disruptions and ensuring the smoothest operations possible. We will keep you updated on any further developments.
